Shutterstock to acquire Envato

Shutterstock has entered into a definitive agreement to acquire Envato. Envato describes itself as “a world-leading online community for creative assets and tools.” Shutterstock describes itself as “a leading global creative platform offering high-quality creative content for transformative brands, digital media and marketing companies.”

Shutterstock purchased Envato for $245 million payable in cash at closing - a purchase price of 1.4X revenues and 7X EBITDA.

EyeEm Collection to be Used for AI Training

According to an article in TechCrunch, EyeEm has notified its contributors that they will begin using content in the collection to train AI Models unless the content is deleted within 30 days. They have added new terms to their agreements:

8.1 Grant of Rights – EyeEm Community

By uploading Content to EyeEm Community, you grant us regarding your Content the non-exclusive, worldwide, transferable and sublicensable right to reproduce, distribute, publicly display, transform, adapt, make derivative works of, communicate to the public and/or promote such Content.

This specifically includes the sublicensable and transferable right to use your Content for the training, development and improvement of software, algorithms and machine learning models. In case you do not agree to this, you should not add your Content to EyeEm Community.

The rights granted in this section 8.1 regarding your Content remains valid until complete deletion from EyeEm Community and partner platforms according to section 13. You can request the deletion of your Content at any time. The conditions for this can be found in section 13.

Large collections of content have real value for training AI models, no doubt. However, once again, there is a question of what rights an agency has to use content that has been submitted for licensing purposes without express permission from the copyright holder. The DMLA Legal Committee will be exploring best practices. Please feel free to share your thoughts by reaching out to admin@digitalmedialicensing.org.


DMLA Legal Committee Presents


Three-part Series on Releases

Due to the crucial nature and importance of releases to media production, distribution and licensing, the DMLA Legal Committee has made the decision to make its three part series on releases available to the public. The committee has complete two of three parts - the first on People and the second on Places. The third in the series will cover Things and is expected during the summer or early Fall.

DMLA Elections

Please note: the current term of the DMLA Board of Directors is coming to an end. If you are a principal voting member of the organization, you should have received an email with a proposed slate and asking for additional nominations. If you have not received the email, please reach out to admin@digitalmedialicensing.org. Please contact Joe Naylor to make a nomination: joe.naylor@imagerights.com . Nominations will close on May 16.


Visual 1st Conference

Visual 1st, the annual conference that promotes innovation and partnerships in the photo and video industry, announces this year’s panel topics, as well as the first fireside chat presenter, moderators, panelists, presenters, and Visual 1st Awards judges. Visual 1st will be held October 16-17 in San Francisco, and we’re a proud partner of this conference.

This year’s first announced fireside chat presenter is Jeff Herbst, early stage AI and frontier technology investor and Founding Managing Partner of GFT Ventures, a fund that also invested in last year's Visual 1st Best Technology Award winner, BRIA. Jeff will share his perspectives formed by his journey from 20 years as NVIDIA’S VP of Business Development to founding GFT, a $140M venture fund focused on AI.
